Before you decide to say “I do” and enter into a lifelong, or sometimes not so life long relationship, you need to ensure that you and your partner have signed an antenuptial contract stipulating the correct terms of your agreement and ensure you are not married in community of property. If you have failed to sign the antenuptial contract and hastily appeared before the Elvis Presley impersonator, your marital regime is regarded as in community of property – meaning the two parties share in one another’s assets and is regarded as one.
 

Luckily, this is not the end of the road and you can still apply to the High Court to amend your marital regime. If you are also no longer satisfied with the content of the antenuptial contract, you can also apply to the High Court to amend the antenuptial agreement. However take note that to apply to the High Court is a costly exercise.
 

Our advice is to rather ensure you appear before a notary public, as law firms deliver such service and sign the antenuptial contract before date of marriage and ensure that the content is correct.
